Wooga GmbH (“Wooga”, “we” or “us”) provides this Supplemental U.S. State Law Notice (“Supplemental Notice”) in addition to our Privacy Notice. The information below supplements the Privacy Notice and is intended for consumers from select U.S. states, in accordance with applicable state laws. Wooga uses and shares information as described in this Supplemental Notice.
ADDITIONAL DISCLOSURES FOR CALIFORNIA RESIDENTS
The following disclosures supplement other disclosures in our Privacy Notice with additional information to which California residents are entitled under the California Consumer Privacy Act (CCPA). The following chart describes the CCPA-categories of information Wooga has collected, disclosed, shared, or sold in the last twelve months.
Wooga does not sell or share for purposes of cross-context behavioral advertising the information of consumers under 16 years of age. We may de-identify information for analytics and advertising purposes, in which case we will not attempt to re-identify the information.
Your Privacy Rights Under Applicable State Law
In addition to the rights and information described under the “Your Rights” section, if you are a resident of certain U.S. states, subject to applicable law, you may have the following rights:
To Know and Access: to confirm whether we process your personal information, and, subject to certain exceptions under applicable law, to obtain a copy of the personal information we have collected about you. If you are a resident of certain U.S. states, you may also request information on the third parties to whom we have disclosed your personal information.
Deletion: to request that Wooga delete your personal information. This right may be limited to the extent that Wooga is permitted or required by applicable law to retain information.
Opt-Out of "Sale", "Sharing" and "Targeted Advertising" Practices: to opt-out of certain information sharing practices with third parties. In some states, like California, this information sharing may qualify as a “Share” or a “Sale,” while in other states, this information sharing may qualify as “Targeted Advertising.”
Correction: to request the correction of inaccurate personal information that we may have on file about you.
Obtain additional details regarding Wooga’s information practices: You may have the right to request disclosures regarding Wooga’s information practices.
If you wish to exercise any of the rights described above, please follow the instructions in “Your Rights” section or refer to our Privacy Portal (LINK). We will not discriminate against you, in terms of price or services that we offer, if you submit any of the requests listed above.
Verification and Appeal Process
We are required by law to take reasonable steps to verify your identity prior to responding to your request (except for requests to Opt-Out). Please note that your exercise of these rights is subject to certain exemptions to safeguard public interest (e.g., the prevention or detection of crime) and our interests (e.g., the maintenance of legal privilege). We may verify your request by asking for sufficient information to confirm your identity, such as your name, email address, user ID and information about your interactions with us or our Service. Requests to exercise these rights may be granted in whole, in part, or not at all, depending on the scope and nature of the request and as permitted by applicable law. Where required by applicable law, we will notify you if we reject your request, and notify you of the reasons we are unable to honor your request.
If you are a resident of certain U.S. states, you have the right to appeal a request we deny when we have verified your identity and still decline to honor your request. The process for that appeal will be sent to you separately if your request is denied.
Authorized Agent
Depending on your U.S. state, you may use an authorized agent to exercise a privacy right discussed above. If you are an authorized agent acting on behalf of an individual to communicate with us or to exercise a privacy right, you must be able to demonstrate that you have the requisite authorization to act on behalf of the individual. If you are an authorized agent trying to exercise rights on behalf of an individual, then you can make a request on the individual’s behalf by contacting us as set forth below in the “Contact Us” section with supporting verification information and proof of your own identity.
Additional Information for Residents of Nevada
If you reside in Nevada, you also have the right to opt out of the sale of “Covered Information” (as defined in applicable Nevada law).
Notice of Financial Incentive
On some occasions we may offer incentives to users to perform certain actions in our games, and in return we will grant virtual items. We also offer a rewards program, that provides certain perks, such as rewards and exclusive offers, as well as other programs like sweepstakes or contests. For purposes of these programs, we may collect your name and contact information as well as information about your use of the Services. We may disclose, sell, or share this information as described above. These incentives or programs may be considered a “financial incentive” or “bona fide loyalty program” under U.S. state privacy laws.
The financial incentives we offer to consumers are reasonably related to the value of the consumer’s data to our business. We value the information collected and used based on the good faith estimate of the value of sharing future offers tailored to your interest and providing you with more features in our games, the value of which may depend on the categories of information collected and retained, the expenses we incur in providing the financial incentive, and the product being offered or promoted.
Participation in any incentive program is voluntary, and by signing up for one, you consent to the collection, use, and disclosure of your information in connection with the program. If you later wish to withdraw your consent, you can do so by contacting us, or otherwise following the instructions set forth in the specific program’s terms and conditions, if applicable.
Please note that if you choose to opt-out of the sale or sharing of your information or the use of your information for targeted advertising, your participation in our programs will not be affected and you will continue to receive all the benefits to which you are entitled. If you make a request to delete all your information, however, we will no longer be able to provide you with any program benefits because we will have no way to tie you to the benefits to which you were entitled or to contact you regarding them.
